The three members’ side showed their displeasure by saying that SM’s statement is absurd.
Lawyer Park Gyo Sun of Sejong Law Firm, representing the three members, stated in a phone conversation with Money Today that, “When the three members filled their injunction, they stated that they would keep their promise by attending all schedule event” and “However, the tree members did not know about this China Tour in advance”
Lawyer Park also stated, “SM claims that the contract was made in June but the three had no idea that there would such a concert” and “we believe that it was a concert planned during the distupe (before the rulling came out), and the rulling clearly sate that SM must confer with us before partaking in any event but they, on their high hprse, are telling the three members to appear at the concert and that goes against the Courts’ rulling”
Lawyer Park also stated, “At this time, SM has not even calculated the three members’ profit from their activities from the first half of the year”

In the Courts’ rulling, it said, “SM is nit allowed to creat contracts regariding TV show, movies, concerts, albums or any other activities without the consent of the members of TVXQ”. It also stated, “SM must not interfere with or question any individual activities that TVXQ may pursue”
